Two Mozambican nationals Sibusiso Vincent Fakude (41) Anastercia Timane (43) were found guilty and sentenced by the Komatipoort Specialised Commercial Crime Court on Tuesday, 25 April 2023 for 733 counts of Contravening the provisions of the Counterfeit Goods Act, Act 37 of 1997 read with the Trade Marks Act, Act 194 of 1993.
The sentence followed after the accused were arrested by the Hawks Nelspruit based Serious Commercial Crime Investigation on 10 March 2023 at Lebombo Border Port of Entry, while transporting counterfeit goods (sneakers) from Mozambique into the Republic of South Africa without proper documentation with estimated street value of
R 1 921 897.85.
Accused no 1 Sibusiso Vincent Fakude was convicted on count no 1 and sentenced to: R 5000.00 or 3 months direct imprisonment.
Accused no 2 Anastercia Timane convicted on count no 3 to count no 733 and sentenced to R100 000.00 or 3 years imprisonment, of which half is suspended for 5 years on condition that accused not be convicted and found guilty of Contravening the provisions of the Counterfeit Goods Act, Act 37 of 1997 in the period of suspended sentence.
