A Mozambican national Lurdes Virginia Moyane(38) was found guilty and sentenced by the Komatipoort Specialised Commercial Crime Court on Tuesday, 25 April 2023 for 1138 counts of Contravening the provisions of Section 83 (a) of the Customs and Excise Act, Act 91 of 1964.
The sentence followed after the accused was arrested by the Hawks Nelspruit based Serious Commercial Crime Investigation on 1 March 2023 at the N4 near Komatipoort while transporting counterfeit goods (sneakers) from Mozambique into the Republic of South Africa without proper documentation with an estimated street value of R 3 425 036.22 together with her co-accused Mandlenkosi Mishanga (38) against whom the case was withdrawn.
Lurdes Virginia Moyane, was sentenced as follows : Count 3: Contravening the provisions of Section 49 (1)(a) read with Sections 1,3,7 & 9 of the Immigration Act, Act 13 of 2022 was sentenced to R5000. 00 or 2 years imprisonment.
Count 4 to count 1138: was sentenced to R 200 000.00 or 3 years imprisonment of which half is suspended for 5 years on condition that accused not be convicted and found guilty on these charges in the period of suspended sentence.
